Terms And Conditions

The following terms and conditions will apply to all bookings. We ask that you take a moment to read them prior to making a booking herein.

Please note that the Terms and Conditions contained herein will be deemed to have been accepted by the Guest unless written objection to any clause herein is provided to 80 On Benade prior to a booking being secured.  In such instances, 80 On Benade reserves its rights not to provide accommodation to such persons.

In these terms and conditions, which apply to all bookings, the following words shall mean:

1.1    “Guest” means the person who will be accommodated at the Guest House and/or his/her agent(s) or representative(s);

1.2    “80 On Benade” means Guesthouse, situated at 80 Benade Road, Fichardtpark, Bloemfontein, its owners, managers, agents, and employees; and

1.3    “Terms and Conditions” means the terms and conditions of the stay contained herein, together with any additional documentation, including, but not limited to, indemnity forms, invoices, and any correspondence addressed to the Guest.

 

2.     BOOKING PROCEDURE

2.1    Bookings must be made at least 24 hours in advance. Quotations for accommodation will be based on availability at the date and time of quoting and will be subject to change, with written notice, at any time before the booking is secured

2.2    Guests will receive a written booking confirmation once the booking has been secured via payment of a deposit or, and only instances where bookings have been made through a travel agent or tour operator recognised by 80 On Benade, upon the presentation of a billing voucher.

2.3    Guests must kindly note that a fee of R60.00 will be charged for any cash deposits.

 

3.  CHARGES, DEPOSIT AND PAYMENT

3.1    The price quoted by 80 On Benade on a pro-forma invoice will be the full and final price to be paid, subject to the Guest securing his/her booking within 24 hours of the pro-forma invoice being issued.  Should the Guest not secure his/her booking timeously, 80 On Benade reserves its rights to reissue a pro-forma invoice with an altered price.

3.2    The Guest is required to pay 50% of the total price quoted on the pro-forma invoice (being 50% of the total accommodation price) to secure his/her booking.  The Guest is required to pay the outstanding balance within 24 hours prior to arrival.

3.3    Should the Guest fail to make payment as contemplated at clause 3.2, 80 On Benade may treat the booking as having been cancelled without further notice.

 

4.  CANCELLATIONS AND NON – ARRIVALS

4.1    The cancellation of any booking must be made in writing and, in the following cases, the Guest shall be liable, without exception, to 80 On Benade as follows:

4.1.1    In the event that the booking is cancelled 7 days or less prior to the Guest’s arrival or during the Guest’s stay, the full accommodation amount will be forfeited and, in instances where the Guest has not yet made payment of the full accommodation amount, the Guest shall be liable to 80 On Benade for the outstanding amount.

4.1.2    In the event that the booking is cancelled 14 to 8 days prior to arrival, the full deposit will be forfeited and, in instances where the Guest has not yet made payment of the deposit amount, the Guest shall be liable to 80 On Benade for the outstanding amount..

4.1.3    In the event that the booking is cancelled more than 14 days before arrival, the Guest will receive a full refund.

4.1.4    A handling fee of R100 will be charged for cancellations.

4.2    80 On Benade reserves the right to determine any additional cancellation fees, which determination will depend on various factors, including, but not limited to, the length of notice of the cancellation provided by the guest,  the reasonable potential to secure another guest in the instance, and the general practices in the leisure industry.  Any decision in this regard will be solely at the discretion of 80 On Benade.  In respect of each such incident, 80 On Benade will exercise its discretion de novo and no decision of 80 On Benade will be deemed to create any reasonable expectations on the part of any guest.

4.3    All rooms that have been confirmed will be held until 23h59 on the scheduled date of arrival at which time 80 On Benade may let the room to a person other than the Guest without further notice, unless notified of a late arrival.

 

5.  CHANGES TO BOOKINGS

5.1    Changes to bookings must be made in writing. No amendments are valid unless written confirmation has been provided by 80 On Benade. Rate variations may apply, depending on the nature of the change.

 

6.  CHECK-IN / CHECK-OUT

6.1    Guests may check-in at any time from 14:00 – 18:00 on the day of arrival. Guests are to check-out by 10:00 on the day of departure.

6.2   Late checkouts are available upon request but are subject to availability and may incur an hourly rate at 80 On Benade’ discretion.

6.3 Check-ins after 18:00 are subject to a late check-in fee.

6.4 80 On Benade reserves the right to charge an additional fee should the guest require an early/late check-in or check-out.

 

7.  NO SMOKING POLICY

7.1    All indoor venues and 80 On Benade’ rooms are non-smoking. Guests wishing to smoke may do so in designated smoking areas located throughout 80 On Benade. 80 On Benade reserves the right to charge an additional amount for cleaning of the room and loss of business for 24 hours after the Guest has departed in order to clear a room of smoke before re-letting to another Guest.

 

8.     CHILDREN

8.1    The use of the swimming pool is entirely at the Guest’s own risk. It is highly recommended that an adult accompany any children under the age of 12 years old to the swimming pool.  80 On Benade will not be liable to any persons for an damages to person or property sustained as a result of the use of its facilities

 

9.  DAMAGE TO OR REMOVAL OF GUEST HOUSE PROPERTY

9.1    The Guest will be liable to 80 On Benade for any damage caused to the Guest House room or any furnishings, fittings and equipment therein by any act or omission of the Guest, his/ her invitees, subcontractors or guests.

9.2    80 On Benade reserves the right to charge Guests the cost of replacing any items that are removed from 80 On Benade. The charge will be the full replacement amount of the missing item.  In the event that it is not possible to replace the item, the Guest will be liable to pay the reasonable costs associated with replacing the item.

9.3    80 On Benade reserves the right to take action against any Guest found to have tampered / interfered with any equipment throughout the Guest House.

9.4    Should it be apparent that that any damage has occurred and/or any item is missing come to light after the Guest has departed, 80 On Benade reserves the right to charge the Guest.

 

10.  LOST PROPERTY

10.1     If 80 On Benade staff find any personal effects, goods left behind by a Guest or any other lost property, 80 On Benade will retain such items for a period not less than 3 months, where after it will be disposed of by 80 On Benade at its discretion.

11.  BEHAVIOUR

11.1    80 On Benade reserves the right to judge acceptable levels of noise or behaviour of the Guest or invitees of the Guest who must take all steps necessary for corrective action as requested by 80 On Benade. 80 On Benade is situated in a residential area, therefore loud music is not permitted after 23:00. In the event of failure to comply with the aforementioned requirements and/or with 80 On Benade’ request, 80 On Benade may terminate a booking and/or function/event immediately, without being liable for any refund or compensation.

 

12.  AVAILABILITY AND USE OF FACILITIES

12.1    80 On Benade will do its best to ensure that all facilities listed by the Guest House will be available during your stay. However, we cannot guarantee that they will be available as maintenance and other work may be necessary from time to time. The use of facilities are for guests only. Facilities are open from 08:00 to 22:00.

 

13.     PETS

13.1    Small domestic pets are permitted, You agree to be fully responsible for your pets captivity in the yard during your stay. Every effort has been made to make it as secure as possible for most dogs, but some pets will always escape.  We encourage you to keep the gate closed during your stay.  Pets are not to be left unattended inside 80 On Benade. You are responsible for your Pets at ALL TIMES.

 

14.  HOTEL EVENTS

14.1    Please take note that at certain times during the year 80 On Benade may host functions and/or events, which may be considered a disturbance or an intrusion during the Guest’s stay. Please contact 80 On Benade should you require any further information.

 

15.     LIABILITY

15.1    All warranties, conditions and other terms implied by statute or common law are, to the fullest extent permitted by law, excluded from this Agreement.

15.2    80 On Benade shall have no liability to the Guest and/or the Guest’s invitees, visitors, employees, sub-contractors or invitees for any special, indirect, consequential loss or damage unless caused by gross negligence or otherwise provided for in this agreement, 80 On Benade’ total liability shall, wherever permitted by law, be limited to the value of this agreement.

15.3    unless 80 On Benade is liable under clause 15.1 herein, the Guest shall indemnify 80 On Benade against any / all liability and any claims, proceedings and/or damages arising from or by booking, function, the guest, his/her invitees, visitors or any service provider engaged by the guest.

15.4    The Guest is advised that parking is limited to one parking bay per room. Extra bays are available on request at R30 per vehicle. Guests are encouraged to lock their motor vehicles and rooms at all times unattended.

Guests should take note that parking areas are not supervised and the guest house does not accept responsibility whatsoever for damage to, or theft from theft of, motor vehicles parked on the hotel premises or from rooms in the hotel. 

 

16.  FORCE MAJEURE

16.1    80 On Benade shall not be in breach of the Terms and Conditions if it does not provide the services hereunder, and it shall be entitled to cancel a booking if it is no longer able to provide the accommodation, due to one or more of the following circumstances:

16.1.1    any part of 80 On Benade is closed due to fire, alteration or redecoration by order of any public authority or any reason beyond 80 On Benade’ control;

16.1.2    there is a failure to supply 80 On Benade with gas, electricity or water outside of 80 On Benade’ control;

16.1.3    80 On Benade is unable to fulfil the booking as a result of industrial action by its staff or one of its suppliers;

16.1.4    fire, lightning, explosion, riot or civilian commotion, malicious damage, storm, tempest, flood, burst pipes, earthquakes, or impact resulting in 80 On Benade being unable to provide the booked facilities;

16.1.5    80 On Benade or any part thereof is designated for alternate use.

 

17.  CANCELLATION BY 80 ON BENADE

17.1    80 On Benade shall be entitled to cancel any booking immediately if a Guest is in arrears with payment to 80 On Benade and/or if a Guest becomes insolvent and/or has an administrator appointed over his/her affairs, and/or if a Guest breaches any of the other Terms and Conditions.

 

18.  ACCURACY OF INFORMATION

18.1     All information, pictures and descriptions on our website have been compiled with the utmost care.

 

19.  GENERAL

19.1    80 On Benade reserves the right to allow visitors until 22:00, extra guests staying overnight will be charged an additional full night’s stay for the unit and a penalty of R200 per person per night.

19.2    80 On Benade reserves the right to deduct any sums owed to it by the Guest and the exercise of such right shall be without prejudice to any other rights, which 80 On Benade may have in terms of the Terms and Conditions and/or in law.

19.3     The Terms and Conditions will be construed in accordance with South African law and the Guest agrees to submit to the non-exclusive jurisdiction of the appropriate South African Magistrates Court, regardless of the monetary value of the claim.

19.4    Any notice or invoice hereunder shall be duly served on either party if delivered to the address provided in any documentation submitted by either party and, in the instance of the Guest, including, but not limited to, information provided in writing through any communications exchanged with 80 On Benade.

19.5    No variation of the Terms and Conditions shall be valid unless it is in writing and signed by, or on behalf of, each of the parties.

19.6    If any provision of the Terms and Conditions is found to be invalid, illegal or unenforceable, that provision shall, to the extent required, be deemed not to form part of the Terms and Conditions and the validity and enforceability of the other provisions of the Terms and Conditions shall not be effected.

19.7    Failure to exercise, or any delay in exercising, any right or remedy provided in terms of the Terms and Conditions and/or by law to 80 On Benade shall not constitute a waiver of that (or any other) right to remedy, nor shall it preclude or restrict any further exercise of that (or any other) right or remedy.
